Last week the Govt. Channel of Lok Sabha TV presented a gender discussion on Misuse of Dowry laws. Well as far as misuse is concerned, let me be very specific as to what I mean by it. Misuse of dowry laws pertains to, Lodging a false complaint of dowry harassment against husband and in-laws and then misusing state machinery to achieve adverse goals. However, Supreme Court Advocate, Meenakshi Lekhi, who was present on the show, was highly reluctant to accept the misuse, though she did after the citizens blasted her with their complaints and harassment as they were victims of the law misuse. But the recent judgment by the Honorable Supreme Court of India, barely days after the discussion was aired, must be a blow to her face, wherein the Supreme Court quashes a dowry harassment case against NRI husband. However, the bone of contention is not the validity or gravity of the claims of misuse. With the Honorable President of India and the Honorable Chief Justice of India having expressed concern over the rampantly growing misuse, its acceptance is not a rarity now. Rather this article focuses on other issues pertaining to it. Coming back to the case at hand, the NRI husband, Harmanpreet Singh Ahulwalia, being relieved of a false dowry harassment case, there are two things noteworthy here. Lower Judiciary inept in dealing such cases: Knowing well, that the allegations made were not based in India, and were rather based in Canada, the case simply made no ground to be contested here as the jurisdiction was wrong, the lower court completely erred in continuing the prosecution even after the police gave clean chit to the husband. Also the fact that the girl's father was related to the police department and had connections within the department was ignored. If at all the allegations held some ground, the complaint would have been made in Canada, but since the legal system there is better than in India, the girl's father chose to misuse the state machinery against the hapless and disempowered husband in India where misuse of dowry laws is as easy as ordering a pizza, further adding to the fact that the lower judiciary is inept and incompetent in meetings ends of justice. Caution note for men, avoid nagging wives: Another close study of the case at hand reveals two important things.
a. Threatened/filed her ex-hubby with false cases. b. Extorted money from her ex-hubby.
